Definitions

Personal data: Any information about an individual, allowing direct or indirect identification (Data Subject), including identity established by social, cultural, physiological, or psychological factors, either alone or in combination with other information.
Seller: UAB „Ottensten“, a legal entity registered in Lithuania (company code: 111520074, VAT code: LT115200716), address: Savanorių pr. 187, 31 korpusas, LT-02300 Vilnius.
Partner: A legal entity selling products/services to the Seller or collaborating on customer orders or joint projects.
Account: Created by the Buyer on the Website to store order history and other personal data.
Buyer: An adult individual; minors (14+) with parental consent; legal entities or authorized representatives of these persons.
Privacy Policy: Document describing how the Seller collects, stores, and manages Buyer’s personal data on the Website.
Website: The online store www.ottensten.lt.
Parties: Seller and Buyer collectively.

General Provisions

These Terms, accepted by the Buyer at checkout, constitute a binding agreement outlining the rights and obligations of the Buyer and Seller, purchase processes, payment, delivery, returns, and warranty conditions.
Creating an account means the Buyer agrees to these Terms, forming a long-term contract applying to all subsequent purchases until updated Terms are published. These Terms also apply to purchases made without registration.
The Seller reserves the right to modify these Terms. The Buyer will be informed of changes during their next login or purchase.

The Buyer is responsible for providing a valid and functional email address.

Contract Formation

A sales contract is created upon order submission—selecting items, providing a delivery address, choosing a payment method, and confirming the order.
The contract remains valid until all obligations are fulfilled.

Buyer’s Rights

To purchase products according to these Terms and Lithuanian law.
To order products 24/7, year-round.

Buyer’s Obligations

To comply with these Terms, Privacy Policy, and Lithuanian law.
To pay for ordered goods as specified.
To pay within 48 hours of order placement. Failure may result in order cancellation.
To provide accurate personal information and inform Seller of changes promptly.

Seller’s Rights

To temporarily or permanently suspend Website activities without prior notice, fulfilling confirmed orders only.
To set a minimum order amount or refuse small orders.
To alter services/products, pricing, and fees. Disagreements result in order cancellation.
To cancel unpaid orders after 2 business days without notice.
To restrict or terminate Buyer’s Website access if security or operations are jeopardized.
To include links to third-party sites without responsibility for their content.
To contact Buyers for order clarification.
To split orders into separate shipments, possibly changing delivery charges.

Seller’s Obligations

To enable Website use per these Terms.
To respect privacy and protect personal data as per Privacy Policy.
To deliver and accept returned products according to these Terms.
To offer replacements or refunds within 14 days if goods cannot be delivered as agreed due to unforeseen circumstances.
To comply with obligations outlined in Terms, Privacy Policy, and Lithuanian law.

Pricing and Payment

Prices are in Euros and include applicable VAT.
Additional services (delivery, etc.) not included unless specified.
Buyers can pay by methods listed on the Website.
Seller may change payment methods or prices anytime except after order confirmation.
The Seller can set minimum order amounts; failure to meet this may result in additional fees or order cancellation.
Orders are stored for 2 business days; unpaid orders may be canceled afterward.
Payment receipt initiates product delivery.
Documents related to purchases (invoices) are sent electronically; the Seller is not responsible for incorrect emails provided by the Buyer.

Product Delivery

Deliveries are available across Lithuania unless otherwise stated.
Buyers must provide accurate delivery details and accept deliveries personally or via authorized recipients.
Delivery timelines are specified on the Website. Delays allow Buyers to cancel orders and receive full refunds unless delays are caused by third parties.
The Seller can adjust delivery charges based on order size and value.
Buyers are responsible for inspecting deliveries immediately. Upon acceptance, risk of damage or loss transfers to the Buyer.
Failure to collect goods after repeated attempts results in order cancellation with a refund, minus delivery fees and administrative costs.

Product Quality and Warranty

Product details and quality are specified in descriptions on the Website.
Goods matching their descriptions are considered acceptable.
Warranties vary by product and are specified in product details or documentation.
Buyer rights under Lithuanian law regarding defective goods remain unaffected by warranties.
The Seller usually does not provide warranty service directly; Buyers are directed to warranty service centers.
Variations due to screens (color, size, etc.) or minor product differences indicated in descriptions do not constitute grounds for claims.

Product Returns

Buyers can return products within 14 days after receipt. Certain products exempted by Lithuanian law cannot be returned.
Buyers must notify the Seller in writing clearly stating intent to cancel the contract.
Products can be exchanged within 14 days if available; differences in price are covered by the Buyer.
Refunds or exchanges processed within 14 calendar days.
Returned products must be unused, complete, and in original condition. Damaged or incomplete returns may be refused.

Liability

Buyers bear responsibility for providing accurate registration and ordering information.
The Seller is not liable for issues arising from the Buyer's failure to read Terms or other Website documents.
The Seller is not responsible for third-party content accessible via provided links.
The Seller is not liable for unauthorized third-party use of the Buyer's account details.

Marketing Measures

The Seller may conduct promotional activities, games, or lotteries and announce them via Website or direct communications.
Conditions of these promotions may be changed or terminated by the Seller.

Final Provisions

These Terms are governed by Lithuanian law.
Disputes are settled through negotiations or as per Lithuanian legal procedures.
